Channels (Chelmsford) Management Company Ltd (CCMC) is an organisation set up, as part of planning conditions, tasked with management of the Bellway Phase 1/2 estate. The objectives of the organisation, often referred to as the Residents Management Company or RMC, are stated in its Articles of Association.
The company is responsible for communal areas and services within the development which do not belong to an individual and which must be maintained for the benefit of all. This may include communal open spaces, paving, parking spaces, water features, lakes, play equipment and so on.
The land (as shaded orange in the image below) falls under the legal ownership of the RMC:
A strict condition of planning obligates the RMC and residents to comply with ecology plans which have been worked up in conjunction with ecology company Southern Ecology Solutions. The site is inspected regularly by an ecologist who looks at the impact on the overall area and will issue guidance accordingly. As such there are limitations on what can be done with the land that the RMC is tasked with looking after.
It is important to note that the RMC is not responsible for repairs, maintenance or upkeep of highways or surrounding areas that pertain to agreements made under Section 38 of the Highways Act 1980 neither will the RMC be responsible for costs that would reasonably be expected to be met at public expense via Council Tax charges. The management and maintenance of individual units and their curtilages are the responsibility of each freeholder, housing association or tenant as applicable.
